Antihistamines: extremely helpful, extremely dangerous

A recent post in our Sonoma Personal Injury Blog focused on drowsy driving. It is a dangerous roadway behavior that leads to a large number of serious car accidents every year. Symptoms of drowsy driving include the inability to focus on the road ahead and a slowed reaction time. Sound familiar?

Drowsy drivers exhibit symptoms that nearly parallel those of another dangerous behavior: driving while intoxicated. But what makes drowsy driving even more dangerous at times is the fact that many people don't give the reckless behavior the respect that it deserves.

Car accident caused by Sonoma man falling asleep at the wheel

While you might think that falling asleep at the wheel only happens at night, it turns out that time really doesn’t matter. Car accidents caused by sleepy drivers can happen at any time of day or night, resulting in pain and suffering for those impacted by the crash.

The California Highway Patrol had to airlift an accident victim to a Napa hospital last week when a driver fell asleep at the wheel and crashed his car into two other vehicles in the middle of the afternoon.

Teavana recall could lead to product liability claims

For tea lovers, tea tumblers make it easy to have the tea they love on the go. No one expects this convenience to result in injuries caused by defective products, though. When it does happen, injured consumers may have a product liability claim against the manufacturer.

Teavana, a national retail tea chain, with one location in Santa Rosa and several other locations in California and around the country, has voluntarily issued a recall for glass tumblers that were exclusively sold in its retail stores and online at its website.

Teen stays at home, friends involved in fatal car accident

Whether or not they realize it, parents of teenagers let their kids ride with the most dangerous drivers on the road every day. Young drivers have less experience and often make poor decisions on the road. They are often likely to have friends along for the ride.

This was the case for what was supposed to be a group date for six young people from Newport Beach, California on Memorial Day. The car, however, was without one young man who was supposed to be along for the ride. The boy's father made him stay home and study for a test instead of going out with his five friends.

Fraud suspect leads police on chase, causes car accident

There is no way to predict when an accident might occur. It may happen during rush hour traffic or on a near-empty stretch of highway. A car accident might even occur in the commission of another crime, such as running away from the police.

That is what happened recently when two fraud suspects fled from Central Marin police after a San Anselmo bank employee spotted them. The employee called the police to report someone matching a suspect's description.

Movie-theater shooting victims file premises liability claims

In premises liability cases, the burden is on plaintiffs to show that a property owner or other party was aware of or should have been aware of the dangerous premises, and that the defendant still neglected to take steps to remedy the dangerous conditions. This is a particularly heavy burden of proof that requires a careful legal strategy, even in a case that would seem obviously to favor a plaintiff.

Some premises liability lawsuits in California pose particularly difficult questions for judges, and a case that would seem either completely unfounded or completely warranted may demand significant litigation.

Rear-end collision in Napa sends 3 to hospital

If you, a motorist, are hit from behind by another driver, neck and back injuries that at first seem minor could progress into painful conditions that even keep you from working. Anyone who has suffered a back or neck injury in an auto accident will tell you that it's difficult to do much of anything without experiencing pain, which, if not treated through rehabilitation, could become extreme and chronic.

Several people were recently injured in a multi-vehicle accident in Napa. As the day neared 6 p.m., a pickup truck approached the Maxwell Bridge and crashed into the back of a Prius. The car driver, who reportedly tried to avoid a collision, was injured, as was her 9-year-old passenger.

Asleep-at-wheel driver sentenced for fatal Napa bicycle accident

The driver responsible for a fatal bicycle collision in Napa was recently sentenced to four months in jail. The 21-year-old was convicted of a misdemeanor offense of manslaughter.

Readers in Santa Rosa probably remember the May 2012 accident. The 56-year-old father of a Napa councilman was riding his bicycle on the Silverado Trail when the woman's vehicle drifted to the right and struck the man. He died at the scene, and the driver admitted that she was asleep at the wheel just before the accident occurred.

Defective onesies pose choking risk

Dangerous products of all kinds carry certain risks for consumers, but the risk of injury is amplified when a defective product is meant for children. Parents in Northern California need to be on the lookout for infant onesies that could cause babies to choke.

The product manufacturer, The William Carter Company, has recalled the dangerous garments because a zipper can reportedly become detached, and infants or their siblings and playmates could end up choking on the small part.

California focuses on distracted driving in April

When was the last time you answered a phone call while behind the wheel? Do you ever send or read text message while driving? Unfortunately, many Americans continue to participate in these hazardous behaviors, despite the fact that they are clearly risky and potentially deadly.
